Recreational Vehicles

Under Council's Community Living Local Law Number 1 2018, a recreational vehicle means a wheeled recreational device and any motor vehicle that is used or intended to be used in a public place, and includes a trail bike, mini bike, motor scooter, motor-driven go-cart, monkey bike and any other vehicle propelled by a motor which is used for recreational purposes. It does not include a wheelchair, wheeled toy or a motorised vehicle used for farming purposes.

There are a number of state and Local Laws that regulate the use of recreational vehicles.

Victorian Road Rules

The Victorian Road Rules exist to help keep our roads safer for all road users. Riding an unregistered vehicle on the road is an offence. Penalties apply to those caught by Victoria Police breaking the rules and may include monetary fines, loss of permits or driver licence, demerit points or you may be taken to court.

Council Local Laws

Under Community Living Local Law Number 1, 2018, clause 2.9:

A person must not use or ride any recreational vehicle on any footway or public place (other than a road) unless in an area designated by Council with erected signage advising that such activity is permitted.

An authorised officer may impound any recreational vehicle if any person using a recreational vehicle contrary to this clause 2.9 fails to cease the practice when directed to do so.

If you ride a recreational vehicle on any footway or public place (other than a road) unless in an area designated by Council with erected signage advising that such activity is permitted, you may be issued an on-the-spot infringement of 2 penalty units ($200.00) and your bike may be impounded.

Parks Victoria

Parks Victoria advise that you may be eligible to ride on some tracks in Parks Victoria parks and reserve roads open to the public. However, for environmental protection reasons it is illegal to drive off formed roads. Some of these roads are designated ‘Management Vehicles Only’ and some public roads are closed during winter for safety reasons or to protect the road surface. These roads will have barriers and signposting to advise they are not open for public use.
